Terms of Service

1. Acceptance of Terms

By accessing or using FE8 (“FE8”, “we”, “us”, or “the Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, you must not access or use the Service.

These Terms apply to all visitors, users, property owners, agents, and any person who interacts with FE8, including through AI-native features.

2. Description of the Service

FE8 is a technology platform that enables users to create, host, and manage property listing pages using uploaded content and automated tools.

The Service may include, but is not limited to:

• Image processing, optimization, and hosting
• Automated page layout generation
• AI-generated text and content suggestions
• A visitor-facing AI Concierge (“8”) for property pages
• Lead capture forms and messaging tools
• A lightweight CRM for managing leads
• Analytics dashboards (views, leads, conversion metrics)
• Marketing assets (social previews, QR codes, share links)
• Optional integrations with third-party services (e.g. messaging platforms)

The Service is continuously evolving. Features may be added, modified, limited, or removed at any time.

3. Eligibility

You must be at least 18 years old to use FE8. By using the Service, you represent and warrant that you meet this requirement.

4. User Responsibilities

You agree that you will not:

• Upload content you do not own or have rights to use
• Upload personal data of others without lawful consent
• Upload misleading, fraudulent, illegal, or deceptive content
• Use FE8 for unlawful real estate activity or misrepresentation
• Attempt to bypass, disable, or interfere with system safeguards
• Reverse engineer, scrape, or extract FE8 software, models, or data
• Use FE8 outputs to train competing systems or services

You are solely responsible for verifying all information presented on your property pages, including AI-generated content, before public use.

5. Content Ownership & License

Your Content

You retain full ownership of all content you upload, including images, text, and materials (“User Content”).

By using FE8, you grant FE8 a worldwide, non-exclusive, royalty-free license to:

• Process, store, display, and host your content
• Generate automated layouts and AI outputs
• Serve property pages and related assets
• Create cached or optimized versions for performance

This license exists solely to operate and provide the Service.

AI-Generated Content

FE8 does not claim ownership of AI-generated text or outputs. You may use AI-generated content at your discretion, subject to these Terms.

6. AI Concierge (“8”) Disclaimer

FE8 provides an automated AI Concierge (“8”) that answers visitor questions, summarizes property information, and assists with lead capture.

You acknowledge and agree that:

• The AI Concierge is informational only
• It does not act as a licensed real estate agent, broker, or representative
• It does not negotiate, verify facts, or provide legal or professional advice
• All AI responses are generated automatically and may be incomplete or inaccurate

You remain solely responsible for all representations made about your property.

7. Leads, CRM & Messaging

FE8 may capture inquiries (“Leads”) submitted through property pages, AI conversations, or contact forms.

You acknowledge that:

• Leads are not guaranteed
• FE8 does not guarantee delivery, timing, or response rates
• Messaging may rely on third-party platforms (email, WhatsApp, etc.)
• FE8 is not responsible for missed, delayed, or undelivered messages

FE8 provides CRM-style tools for convenience only. You are responsible for monitoring your dashboard and responding to inquiries.

8. Conversation History & Data Use

FE8 may store:

• AI conversation history
• Visitor inquiries and lead messages
• AI-generated summaries and extracted property facts
• Usage and interaction logs

This data is used to operate the Service, improve functionality, and provide context to users. FE8 may retain, anonymize, or delete data at its discretion, subject to applicable law.

9. Hosting, Availability & Free Tier Limits

FE8 hosts property pages on your behalf.

You acknowledge that FE8 does not guarantee:

• Permanent hosting or URL availability
• Continuous uptime or access
• Long-term storage of free-tier listings

FE8 may impose limits on free usage, including the number of listings, features, or capacity. Free features are subject to change and availability.

10. Paid Plans & Billing

Certain features may require payment.

By purchasing a paid plan, you agree to:

• Provide accurate billing information
• Authorize recurring or one-time charges (if applicable)
• Accept that fees are non-refundable unless required by law

FE8 may change pricing or plan features with reasonable notice.

11. Third-Party Services

FE8 may integrate with third-party platforms and services. FE8 does not control and is not responsible for the availability, accuracy, security, or policies of third-party services.

Your use of third-party services is subject to their respective terms.

12. Intellectual Property & Platform Rights

All rights, title, and interest in FE8, including its software, design, algorithms, branding, and systems, belong exclusively to FE8.

You agree not to copy, reproduce, or create derivative services that imitate FE8's functionality or presentation.

13. Termination

FE8 may suspend or terminate access to the Service at any time, with or without notice, including for:

• Violations of these Terms
• Abuse or misuse of the Service
• Legal, technical, or security reasons

Upon termination, property pages, data, or access may be removed or disabled.

14. Disclaimer of Warranties

The Service is provided “as is” and “as available.”

FE8 makes no warranties that:

• The Service will be uninterrupted or error-free
• AI outputs will be accurate or complete
• Property pages will always be available

You use FE8 at your own risk.

15. Limitation of Liability

To the maximum extent permitted by law:

• FE8 is not liable for indirect, incidental, or consequential damages
• FE8's total liability shall not exceed the greater of $50 or the amount paid by you in the past 12 months

This includes loss of data, revenue, leads, or access.

16. Indemnification

You agree to indemnify and hold harmless FE8 from any claims arising from:

• Your use of the Service
• Your content or listings
• Your violation of laws or third-party rights

17. Modifications

FE8 may update these Terms at any time. Continued use of the Service constitutes acceptance of updated Terms.

18. Governing Law

These Terms are governed by the laws of the jurisdiction in which FE8 is legally registered, without regard to conflict-of-law principles.
